4.0 Disciplinary Procedures


4.1 The Institution has the power to take disciplinary proceedings in accordance with the provisions set out below, against members who are in contravention of the Articles of Association, Bye-Laws, or Code of Professional Conduct of the Institution.

4.2 The council shall determine whether or not to initiate disciplinary proceedings on foot of a complaint, having made such inquiries in respect of that complaint as the council deem appropriate.

4.3 Rules of Natural Justice These disciplinary procedures shall be subject to the rules of natural justice.
Members charged with professional misconduct must be notified of the said charge in writing.

Members charged with professional misconduct have the right to be present with or without legal representation at all hearings of the Professional Conduct Committee or the Appeals Board when taking evidence in connection with the alleged misconduct.

Members charged with professional misconduct have the right to examine and cross examine at such hearings.

Members charged with professional misconduct have the right to make submissions orally and in writing in their defence to the Professional Conduct Committee, and the Appeals Board.
